You further agree not to use NewMe's website, product information, images, trademarks, or other materials to promote prohibited uses of our products.

You must be at least 18 years old to purchase products from NewMe.

By placing an order, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

NewMe reserves the right to refuse or cancel an order if we have reason to believe the purchaser does not satisfy this requirement.

Submitting an order through the NewMe website constitutes an offer to purchase the selected products.

An order is not accepted until NewMe confirms the order or ships the applicable products.

NEWME DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

NEWME DOES NOT WARRANT THAT:

• THE WEBSITE WILL BE ERROR-FREE;
• PRODUCTS WILL BE AVAILABLE AT ALL TIMES;
• PRODUCTS WILL BE SUITABLE FOR A PARTICULAR RESEARCH APPLICATION;
• PRODUCTS WILL PRODUCE ANY PARTICULAR RESEARCH RESULT; OR
• INFORMATION ON THE WEBSITE WILL ALWAYS BE COMPLETE, CURRENT, OR ERROR-FREE.

Nothing in these Terms is intended to exclude any warranty or right that cannot lawfully be excluded.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEWME AND ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, SUPPLIERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO:

• YOUR USE OR INABILITY TO USE THE WEBSITE;
• YOUR PURCHASE, POSSESSION, STORAGE, HANDLING, OR USE OF A PRODUCT;

To the maximum extent permitted by law, NewMe's total aggregate liability arising out of or relating to a particular purchase will not exceed the amount actually paid by you to NewMe for the product giving rise to the claim.

This limitation does not apply to liability that cannot legally be limited or excluded.

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless NewMe and its owners, officers, employees, contractors, affiliates, suppliers, and service providers from and against claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from or relating to:

• Your violation of these Terms;
• Your violation of applicable law;
• Your misuse or prohibited use of any product;
